Both parents are deceased.Dad signed a quick claim deed before he passed the banks wre notified of their passing,however one bank keeps taking mataince fees out and overdrew the account.Should I pay the overdraft fees?there only going to do it again.

Quit claim was signed to whom? If bank was notified, and you have proof, so what? Let them put all the fees they want, there's no money in the account. Don't pay anything if you are sure they were properly notified.

Had the same problem when my dad past. Called the bank and gave them the address of cemetery and told them to collect it from my dad if they could.

Second, it's a quit claim deed and who was the property signed over to?

Third, What are the maintenance fees for? Whose name is the account in? If there was a mortgage, the mortgage still exists and it is the responsibility of the estate to pay it.

Has the estate been probated?

As you can see you left out a lot of details that we need to be able to provide an answer.

Have you filed the new deed at the court house ? Was it properly witnessed and notarized ?

But you don't pay the bank, who has went in to close the account ? Who has went in and sat down with perhaps one of the managers or VP and explained this to them.

Again its QUIT claim deed. The titleholder is quitting their claim to the property in favor of another party.

But that's only one small piece of info we need answers to.

The deed is all been noterized and file in the court.I own the house.I went to the bank and gave them both deathe certificates.They told me that in order to close the account I had to go to court or wait 5 years for the account to go to the state of nh.ThenI could pition the state.

Do you want our help or not? If you don't answer our questions, we can't help. The issue is not whether you own the house or not. The issue is what is the nature of this account, what are the maintenance fees for? Did you probate the estate (sounds like you didn't)?

Unless the estate is closed any and all claims from death until that closing are the responsibiity of the estate. It is not a "given" that the bank cannot collect.

Scott asks insightful questions that need to be answered.

The only question you answered was about who the property was deeded to.

You did not answer the above questions And since your question was about the account, those are the more important questions. Nor did you specifically answer whether the estate was probated or not. You did say you were told you need to go to court, but that only suggested it wasn't probated.

What I think is rude is asking for help and not answering the questions needed to give that help. You were asked questions And then reminded that we needed the answers. And yet still didn't provide them.

My answers were accurate according to the info you gave. So giving me a negative rating was another rudeness.
