What is the written custody agreement ?

The likelihood is that you can, but I would go back to court for permission. As long as there is a visitation order in place, I would not make a move that would not allow the parents to maintain that visitation order without court approval.

Go back to court, petition the court to modify the visitation. Show how the parents have not been exercising their visitation rights for an extended period and how the move will benefit the child. The court will probably approve your move.
