Question about my mom's case. My mom just had her visa interviewed. And she got denied, because they found out that I'm not her real daughter. She kept me and raised me cause she can't have a kid herself. We don't have a adoption paper, because my real mom is her sister. My real mom know that she can't take care of me, because she have 3 kids already and she had a divorced. Now, I'm so sad because, my mom can't come here and live we me here in United states. I owed my life to her. My Dad, her husband is American citizen. (But my Dad passed away 18 yrs ago.) That's the reason why I got my U.S citizen. They didn't really file for adoption because they didn't think that they will need that in the future. Now, my mom got denied at the U.S embassy manila Philippines. I was wondering if there's another option to bring my mom's here.. please. Help.. Our papers are good not fake. But the only thing is missing is the adoption papers. My real mom just gave me away to my mom. So, they didn't really think about getting a adoption papers for me. Please Help..

How exactly did you get here based on your father, if he is no more your father than your mother is your mother? If you were accepted based on your father, and he isn't your father, then it seems only fair and right that your mother should be allowed here too, because she married him! Regardless of technicalities like that, I would guess that a good lawyer and enough proof that you were raised by your mother, not her sister, then you have a chance. Find a lawyer who will give you a free interview and give you a sense of how good your chances are. You need to spend time finding one with an honest reputation, who won't take your money and never deliver.
Hopefully an immigration expert will answer. I might even pay a fee on an online lawyer site.

Thanks for your answer. I was accepted both of them. As soon as my biological mother gave birth to me, she gave me to them. So, my adopted mom and dad raised me. But mostly my mom because my dad he's a seaman. He stays in ship most of the time. Now, they didn't.have legal adoption papers, that's the reason why she got denied from the U.S embassy manila. I know getting lawyer is the option. But this is going to cost me a lots of money. I will try to get an free interview lawyer, like what you said. Check what are my chances. Thanks again. You didn't explain how you got to be here based on a father who isn't your father. If they accepted that, they should accept his wife!

Ohh, sorry. As soon as my biological mother gave birth to me, my biological mother gave me to them. And my adopted dad and mom, kept me and registered me in their name. My mom said that she couldn't have a baby that's why she adopted me without any legal adoption papers. My dad before his going back to U.S he applied citizenship for me. All my papers are legal, my birth certificates, my U.S citizenship. When I filed for petition for my mom, I couldn't send the adoption papers because, we don't have one. This maybe a dumb question, but do you think we can get an adoption papers still?

Sorry but he was not your real father, and your citizenship is based on your Uncle, not your dad, he never adopted you, so the immigration made a error in giving you citizenship.

You can not have legally become a citizen from this man, since he was and is not your father any more than the women is your mother.

If immigration discovers this , I am not sure what they would do, he could have never legally applied for your papers, since he had to lie on the paper work and claim to be your father.

You have more issues than just getting your mother here

I was worried about that too, and that's why I kept asking how she got into the US from a father who isn't her father, and am worried that the US could deport her.
That's one more reason to see a lawyer with a known reputation.

I was worried about that too. I will ask the lawyer, since this issues is open. I wish my dad was still live. They didn't know about adoption papers. I still owed my life for them for raising me. Thanks for your answers.

Thank you. Her interviewed was just yesterday morning. We were both sad because we were excited we thought that she will get her visa. I am 31yrs old, female, married and have a daughter. Thanks for wishing me luck..

Yeah, I do want to talk to a lawyer. Its kind a sad because this is happening. They did a good thing of raising me, but they didn't know about the adoption papers law.I guess in the philippines there's no law like that. I don't know.. but I'm doing my research. Trying to get free interview lawyer about this case. Thanks so, much for this answer. Is not the answer what I'm looking for, but it gave me idea to do the right thing.

Go to travel.state.gov (the US state department) to read about a travel visa, hopefully for 6 months. It's a lot faster if she is 80+ years old. There are even ways to apply for extended stay, as long as you do it before she has to go home. There are also ways to have a longer visa for medical treatment, requiring a doctor's statement.
A long visit, if you can afford a round trip ticket (I don't think you are allowed to buy a one way, but I might be wrong about that), would help you both work on this here. And it would mean you get to see her sooner.

There is nothing wrong with immigration here. Once you are adopted and become US resident, you are no longer eligible to petition your birth mother or any so called "mother".

lawanwadee, she was never adopted, and the mother she wants to bring over isn't her birth mother. Does that change your response?

US citizen can petition GC for birth mother (if he/she has never been adopted by someone else) but in this case there is no evidence of relationship.. just raising her is not enough. The key is how she became US resident in the first place... she probably has no clue on what category she was in or has she been adopted (on paper only.. for immigration purpose)??
