Here is my situation. My wife and I are separated. She has the car which is registered in my name in another state. The loan is in my name.

I need to find out how I can have her get her name on the registration and get the car registered in the state that she now lives in and works in, while keeping the loan in my name. As I have agreed to keep paying for the car.

You probably can't - if you default and the car is in her name it is that much more difficult for the bank to get its money.

Contact the lender and ask them.

I am in Georgia, and she is in Rhode Island.

I contacted the lender, in order to have her put on the title, she has to be put on the loan. I am just trying to get the car legal in the state that she is in.

If the lender has a lien on the vehicle then it is unlikely you can transfer ownership. I really don't see a big deal in leaving it in your name, maybe with a letter allowing her to use it.

Yes the lender has a lien on it. The problem is, I am in one state and she in another. 1100 miles apart. The tags will expire here in a few months, she has no plans to come back to the state that I live in.

She does not want to run the car with expired tags, nor do I wish to travel there, drive the car back, just to get it registered for another year in this state, then drive it back to her.

If I could pay the car off I would, and just sign it over to her, but at this point and time I cannot.

She can register the car in her name so long as you sign the registration. The main thing is the title on the car. The lien company must remain as a lien holder. Registration is separate from title.

To add to what califdad said, Most DMVs now have online registration. So you should be able to go on the state's websites and see what is necessary to switch registration (not title) into her name to get new plates.

Unless you live in Atlanta, or other metro area, you don't have to have the car present to get the new tags, just pay the fee and that is it.

But no, as long as the loan is in your name, it will be registered in your name. She needs to get her own loan to pay it off and take over ownership.

Thanks Fr Chuck, yes I live in the Metro Area. I did however find that I may be able to get a waiver for emissions check. I am currently looking into that.
