    Father not on birth certificate
    Do I have to establish legal custody even though birth father is not listed on birth certificate and has never seen my 2 year old daughter?

    Yes. If you don't the presumed father can apply for visitation, custody, etc. at any time he so chooses. At that point he will then submit to a paternity test. If he is found the biological father, depending on where you live, you may have to pay the costs of the test as well as court costs.

    Do I need a lawyer? Is it an expensive process?

    Depends on the state and whether the father will fight it. If there is no challenge it shouldn't need a lawyer nor cost more that nominal court fees.
