I filed for restraining order and was granted a permanent one for 5 years. Now can I sue him for emotional distress for Domestic violence and for having to go through the court to keep him away. He has physically abused me, threatened me and my family anfd stalked and harassed me. I do still live in fear of him even with the permanent restraining order and my kids are traumatized also.

Anyone can sue anyone for anything. The question is whether you would win. To know that you would have to contact a local attorney who knows local laws and the mood of the courts.

You also have to consider whether he has the money and/or assets to pay any award you might get.

My guess is you would be wasting your time and money.
