    My husband is ilegal and we have been married for 3years can I get his green card with out him going back?

    It doesn't work that way.. marriage doesn't grant you any right to a green card.

    HE has to apply, HE has to to qualify (being an illegal makes that less likely to happen) HE has to pay the fees, and you both have to wait.

    Odds are they are going to have to go back during the application process... but even there there is no guarantee it will EVER be accepted... even if you hire a immigrations lawyer... I know someopne who has been trying for 10 years... paid tens of thousands of dollars in lawyers fees and application fees... and found out she would never be allowed to have one.

    If he entered US without inspection (no visa), he must go back, no other options.

    Yes, it is a myth (or at least not how it now works) that getting married gives you any special rights.

    If he goes back, will you go back and live in his country with him, while he tries to come back legally?
