    Either or neither? There's a big difference? Has custody not been established, or do they share custody?

    If a custody agreement hasn't been established, then I'm afraid the mother (who I'm assuming has full custody of this child) can determine whether the child goes out of state for a month.

    The father will have to go to court to fight for his rights.

    Has there been any court orders for visitation? ANY question on law needs to include your general locale as laws vary by area. One parent has to be the primary custodial parent. That parent can block visitation unless there is a court order for it.
