    Eviction of a spouse
    When my husband and I was legally separated he agreed to live in the ome and make payments and keep it up. I have saved the home from foreclosure several times. He quit his job a few months ago and I have had to make payments to keep it outr of foreclosure. How can I evict him?

    If he is listed as an owner you can't evict him. You can, however, sue him for his share.

    You will need to go through a divorce and have the home awarded to you in a settlement then have him transfer it to you as part of a refinance.

    Agree, to evict, you will have to file for divorce, get the house in court and have him ordered to leave.

    What does the current court papers from the legal separation say ?about his status in the home,

    But you can sue for payments, but if he is not working, does he even have money

    Go back to court and order that the home be sold. Also if this agreement was throough the courts have him cited for contempt. It may not be the best time to sell but it may also be your only way out. By continuing to go in and out of foreclosure your ruining your credt.
