Ok so my kids dad just found out he got another child through dna technically he not the dad he not in the life and is wanting to give up his rights the girl just had the baby for the money if he give up his rights in dayton Ohio will she get money from child support he has no job and is about to get ssi hopefully

He can't give up his rights unless the baby is placed for adoption, or there's another man (husband of the mother) that wants to adopt the child.

In other words, yes, he'll be responsible for child support. If he can't afford to have children, and support them, then maybe he should keep his pants on.

Alty hit it spot on... LEGALLY and "technically" he's the father... DNA proved it... though he may not the "father" the kid grows up knowing.

As the story goes... he had his dance.. now he has to pay the piper.

He's not getting out of the obligation until and unless someone wants to adopt the child.

Life is harsh... and sometimes you pay for 18+ years for a few minutes of fun. This is one of those times.

Well really she didn't hit spot on because she don't know the story behind it all make a long story short he has tried to be there several times his mom and the child's mom clicking together to try and run his life any way when he was coming around they were telling him what he can and cannot do with the child at this point he has no relationship with his mom and he was never with the girl

Doesn't really matter... DNA proved they had sex at least once. And once is all it takes. That's all that matters when child support is ordered. Even if it was a one night stand and he never knew her name.

He's the biological father. If you're saying that he tried to be a part of the child's life, and the mother wouldn't let him (that's what I'm getting from your post, which is very hard to read) well, that's what courts are for.

Either way, he's the bio dad, and he can't give up his rights unless the child is being adopted by someone else. That means that yes, he has to pay child support for what he helped create. If he can't afford to do that, he should stop making children. The child deserves the support, it didn't choose to be here, the parents made that choice when they had sex.

And yes, I did hit it spot on. His story, long or short, doesn't make any difference. The law is the law. He can't give up his rights unless there's an impending adoption, no matter what relationship he has with his mother, or the mother of the child, or the child itself.

Whooo... relax. Who's jumping down your throat? I see answers to your question. Perhaps they're not the answers that you wanted to hear but they are correct answers anyway.

You asked for help and your posts are very hard to read. So, get off her back and anyone else who is critical of the spelling, punctuation, and grammar in your post. We are volunteers and we don't have to take your attitude.

Oi! The story doesn't matter. Grab a brain and listen to the facts.

You asked about the law, and I gave you the law. Just because it's not what you want to hear, doesn't mean you have to get all pissy.

    The law.

    1. A DNA test shows he's the bio dad. Is that or is that not the case?
    2. He can't give up his rights unless the child is being put up for adoption, or there's another man (husband or partner of the bio mom) that wants to adopt.
    3. Not being able to afford child support will not get him off the hook for child support.

Those are the facts. We don't need to hear the story, it doesn't change anything. The facts are the facts. You don't have to like them, but you do have to live with them.

    Edit:

You can't delete this. The rules of this site are clear, they were given to you when you joined, if you chose not to read them, that's your problem. Deleting posts isn't done unless they go against site rules.

I don't know what part of my post irritated you. I'm guessing you wanted someone to agree that he can go against the law and give up his rights, or be a dead beat dad. If that's what you want, call your friends, they'll agree with you, and maybe they'll go to court with him when he's charged for not paying child support because he doesn't want to accept that the law is the law.

    Good bye and good luck.

Because usually... most of the time... the guy is the bad one in these cases. Not always, but most of the time. Too often the guy has a kid and wants nothing to do with it.

Of course I'm getting smart, because I am smart.

I answered your question immediately, it's you that came back wanting to explain, tell the story, expecting that the law would change when you did so.

I did say he should keep his pants on. That's a given, since he doesn't want to pay support for the child he helped create, and you're the one that said he didn't want to pay support.

Maybe you should re-read your posts and all the replies you got, because this question was answered on page one, with the first post. You're the one that wouldn't accept it.

You probably meant to say something derogatory, but it got lost in the lack of grammar and punctuation. What a shame!

Mods, I think it's time to close this thread. The OP's question has been answered, was answered the very first post and then some, and nothing she adds, if we can decipher it, will change the answer. She's been given the facts ad nauseum, and now it's up to her to accept them.
