So neither of you has official custody?
Then you go to court first. Go down to town hall and find the Family Court and fill out an application.

Or, in most places, he would go down to the courthouse and file a custody petition. I don't know of anywhere that a family court is found in the town hall. He really needs to hire an attorney.

You said; "she gave full care to me of our son..." What does that mean? Did you go to court at the time? Did she sign something? If so, what and was it signed off by a judge?

The answers to that are key to our advising you.

But the bottom line here is that you need a court order for custody. If the mother wants to fight you, you have to prove that you can provide a better home than the mother can.
