First, questions of this nature cannot be conclusively answered without knowing which state the child was born in.

But if she was married when she gave birth, her husband is presumed to be the father of her child. Therefore it is doubtful that the BC can be changed to show you as the father. Why do you desire to have your name put on the BC?

The best way to get on the BC is to marry her, and then adopt the child. Of course before this can happen her divorce needs to be concluded. To complete the divorce it is not necessary that he sign any papers; that would merely make it easier.

As noted, it is unlikely you can get on the BC. However, you may be able to be declared the legal father. To do so you need to consult a Family Law attorney who can tell if that can be done.
