I have several emails and messages of me asking her when she plans to pay me back and if she doesn't that I will press charges on her, she has made no attempts to fix the situation and I am ready to press charges, I have printed the conversations we had going back and forth on Facebook before she deleted and blocked me, I have given her every opportunity to create a payment plan to pay me for the items she stole and pawned. She is 27 years old and thinks she shouldn't have to pay me back full price, maybe a couple twenty dollar bills since that's what the pawn shop ripped her off for all of it... she's not a smart person so her family supports her but is not trying to encourage her to do the right thing. My husband agrees that she should pay me back for the items she stole. I will never allow her in my house again and am tired of all he snide remarks and am ready to press charges, what exactly is my first step?

You don't press charges, the police do, and it may be too late to get them involved.

At this point I think you'd be better off taking her to small claims court and trying to get your money back that way.

You don't have a criminal complaint, which is why you would call the police. She presumably was invited into your home and you have lost charges of theft by repeated emails asking when 'she will repay you.' So your charge is civil. And if you do win in small claims, she may never pay, and nothing will be done about it. Sorry. Chalk it up to dysfunctional family relationships that many people have.

You needed to have called the police first , your actions have really destroyed any criminal case against her.

Sue her in civil court, and hope to win a judgemetn against her, where you can garnish her pay if she has a job.
