    Hello All,

    I am on H1 and my wife have H4 now. We both came to US on jan,2012. Now my wife went to india on Oct,2012 for delivery. We also applied an H1 for my wife and got to know from her employer that its been approved and her status got changed to H1.

    Now in order to file the tax for me, do I need to apply for ITIN for my wife and file it jointly?

    Also, she will not be able to get SSN till she return back to US on next June,2013.

    Any suggestions?

    I recommend you wait until she gets her SSN, then file.

    Applying for an ITIN is MUCH harder than it used to be, and, In my opinion, is not worth it for an ITIN you will use only once.

    Do you mean to say, I can file my 2012 year tax after June 2013?

    Yes, absolutely. In fact, you can wait as long as 15 April 2015 to file and still claim a refund. I do NOT recommend that, but each year I have at least one client for whom I file 3-4 years worth of returns, each with a refund.
