We have been together for 6 years and now live in an apartment with both our names on the lease. He has physically, mentally, and financially hurt me. He steals my money or "uses it cause it was there and promises to pay it back". When he have had physical altercations, I have been told by the police department I can go to jail for fighting back. Unfortunately, I don't have anywhere else to go, he makes more money than me, and refuses to leave. When we have discussed his leaving or our break up, he has thrown my property into the yard and when I tried to leave he breaks my cell phones (have had 3 in 1 year). He does drugs heavily from morning before work and starts as soon as he gets home. I don't use anything but cigarettes. I'm scared to have the police come and I go to jail for his stupidity. I'm also scared that he will come back and retaliate if he gets evicted. I'm scared of this person and we do have a past of physical violence where he went to jail. Please someone help me to resolve this issue.

1. Stop talking to the police, they tell you this, since this is how it happens, seen it 100 times.

You call police, they arrest him, next morning, you are changing your story an spending rent money to get him bailed out.
So the police are tired of coming out time and time again, when the women does nothing to change it.

2. you can not evict him, he is on the lease. So why don't you move out if it is that bad, I would not stay one minute where I thought I could be physcially hurt.

3. you call the police any time he attacks you,
4, call and report the drugs in the home, testify against him in court on the drugs.

Without a list of police reports to prove the abuse, without a witness or some proof, you will not have much luck in getting any order against him.

If you are physically abused, why don't you speak to a battered women's shelter. You can call them, give them your story, and see if they can help.
