My husband and I loaned a friend of ours $4000.00 He has paid all but $1500.00 back, over a years time. We had no time frame as to when he would pay us back, however, he is now saying he can't pay the rest of it back. We live in Georgia. Is there any way we can get the remaining balance paid back to us in small claims court?

Since there was no written agreement can you at least show the courts some evidence of his $2500 in payments. You will need something to give as proof of the loan if you sue him. Since there was no written agreement you will not likely prevail since there would be no due date for payments or amount
