    Getting date on I-94 extended
    Hi,

    One of my friends who is US for more than a year went to India for vacation. He came back to US in the month of March. His Visa is valid till 2007 end. But his Indian Passport was valid only till 30-Mar. Thus the US Immigration officer put the date of 30-Mar on I-94.

    My friend got his passport extended from Indian Embassy in New York.

    1. What should he do to get the expiration date on I-94 extended?

    2. If the process to get I-94 date extended gets delayed, what should he do on 30-Mar.

    3. Is it legal if he has to stay in US even after 30-Mar while I-94 extension is in process.

    Please let me know.

    Hi Prashant,

    I am also looking for an answer regarding I-94 extension in the event of new passport issuance. Would highly appreciate if you could share the answers in case you get to know from anyone.

    The I-94 is a very important card. An extension of stay should have been applied for already. Since it seems that that was not done, its best to use a lawyer at this time to apply for the extension of stay, so you can have documentation to show that you have not overstayed in US. The visa just allows for entry and what you can do while here. The I-94 dictates how long you can stay for regardless of the time on your visa.
