My son was in the hospital, and while there a nurse in another department who was a friend of my former daughter inlaw obtained information regarding my sons condition. She was not permitted to do so, and used her status as a nurse at the hospital to do so. Upon finding out that she did this, we had his records blocked. We did not tell the hospital why we wanted it blocked other than my son being a victim of a crime. (he was assaulted, and that was why he was in the hospital). Were his Patient Rights violated by this nurse by doing this?

In what country would this be considered parental rights at exactly anyway? Certainly NOT the USA.

I did not inquire about parental rights... read it again... I asked about PATIENT RIGHTS.

Same deal.. in fact I never heard of patient rights... not in the USA... because location is improtant... and due to the fact this is an international site... we need to know what State or provence... and what country this would be applicible to. No rights or laws are Globally universal.

If you wanted to ask About HIPAA you should have simply asked about HIPAA and stated WHERE you lived because MOST of our Members are not in the USA... They are in Canada, the UK, Australia.. and are English speaking citizens of almost every other country as well. It took 5 posts to find that out.

And HIPAA isn't a patients rights act... its a medical privacy law. Two very different things.

I don't know why you think this isn't a friendly place. Yes Smoothy misread your post, but he has still attempted to answer you, even though you initially left out key information.

To answer your question yes HIPAA was violated. You should (and probably still can) report it to the hospital authorities or directly to the OCR.

I Apologize... Bad day and I guess as he read my question wrong, I misinterpreted his response. I apologize Smoothy. This happened in California in August. So I am sure I still have time. I just didn't know if this would fall under the guidelines. Thank you to you both.

Yes, HIPAA was violated here. You can report it to the Administrator of the facility and that nurse will either be reprimanded or fired.
