    Yes a judge has the right; he is higher then a probation officer.

    Probation officers make recommendations. It is up to the judge to decide what to do.

    Yes, but it's not as simple as that.. There needs to be a case in front of the judge for him to rule on. Otherwise, he won't intervene.
