I want to know if I can try to pursue a fraud case because my ex is signing my sons name to paperwork for child support. He is 18 and attending school but he doesn't even know anything about this issue. He is now legally an adult and is choosing to stay in school. The checks are issued in his name but she is cashing them. What can I do here to make sure that my son and his mother are both being held responsible for their actions.

Let me be sure I understand:

You are paying child support payments to the child support agency. The agency then pays this, by another check, to your son. His mother somehow gets hold of these checks forges your son's endorsement on the checks, and cashes them. Is this what you are saying?

I'm surprised that the checks are payable to the son. Normally, child support, even for a child over the age of 18, is payable to the custodial parent. How do you know she has been doing this?

In Oregon it is called Child attending school. He is legally an adult. That is why the payments go to him. If he chooses to quit or is not doing well in school the support stops. She also signed the paperwork that goes to the state stating that he is attending school. He is supposed to be signing this paperwork. He has no idea what I am talking about when I asked him about it. He receives a bank card from the state. It is all done electronically here. They don't issue checks but she is the one using the card. The card is in his name. He turned 18 three months ago and we are trying to work all this out. That's how I know he didn't sign the paperwork. He is clueless to what I am talking about. The point is that he should be taking some responsiblitly for his decisions now. If she wants the money from him she should charge him rent just like any other adult to teach him how to manage money. Also I don't feel it is right for her to sign legal documents that are in his name and asking for his signature. I have asked the state for copies of all these documents so I can have the physical proof that he is not the one signing them.

Is your child still in High School and has yet to graduate? Or is he enrolled in some college or technical course?
