    Adiing my husband to my home title
    After my father died he left his home in myself and my mentally retarded sisters name. She live with my husband and I in my fathers house. My husband and I are her legal guardians and I have power of attorney. The house is now paid for and I want to get my husbands name on the deed. There are no other siblings or family currently the deed is registered under my name and my sisters name. We live in Tennessee what do I do?

    You file a quit claim deed, transferring title from yourself and your sister to yourself, your sister and your husband. Since you have POA for your sister you can sign the deed for both.

    Note that this will split the property evenly among the three of you. If you want to just share your half with your husband, then you will need to specify this in the deed. I would recommend getting an atty or a title company to do the transfer for you.

    For this situation I would suggest that you have this handled by a real estate attorney or title insurance agency. The fact that there is a power of attorney may call for additional requirements. The deed will probably require special language and you may also have to record the power of attorney along with the deed. If you try to prepare the deed on your own and record it then it may not meet the requirements for conveying clear title.
