I am I'm New York state. My daughters father is a drug addict, has a lengthy criminal record of drug charges, 3 counts of endangering the welfare of a child (2 unrelated, 1 for our daughter), he also has a rape in the 2nd° of a minor and has to register as a sex offender, also he is on probation for 10 years. He was found "indicated" of the endangering the welfare of our child by cps. He went to jail (not the first time), and got released into rehab. He went through his rehab and had a job and an apartment which we then shared. It only took a couple months abd he went right back to doing drugs (worse drugs). He stole.money from his roommate and left the apartment with no notice (after I has moved) but the landlord did not take my name off the lease so I was left to clean everything and empty the apartment. He did not take a single picture of our daughter, not even the shirt she made him. I have text messages from him staying that he will not bother fighting to see her because he thinks I will "make it hard for him" and it would be "a waste of his time". All he does is lie and steal and has no regard or respect for anyone or anything. He got fired from his job abd is now couch surfing, violating his probation. My question is, can I take him to court to terminate his parental rights? I have the documentation of his rape charges and the endangering the welfare of our child by cps. He is a deadbeat and is not healthy for my child to be around. He has not seen her since August and has even lied saying she was in the er on his facebbok and that he needed money to go see her. Which was a total complete lie! She is perfectly happy abd healthy! Please I need some help I do not want him in our daughters life, he will only mess with her head not to mention the bullying because her father is a sex offender and very well known thief and druggie.

Maybe, sorry for the unsure answer, it is hard to get their rights taken away. This all together should be, if you have proof of the drugs, the endangering of his child. The issue is, often they will still allow him rights, but merely make it supervised visits at a court operated center.

But you can get an attorney and certainly try

And you agreed to have sex with this man?

You have a small chance of getting his rights terminated, but a very good chance of blocking him from any visitation or say in how your daughter is is raised.

Actually all this occurred after our child was conceived. He did have a record of drugs but said that was in his past. Its not like I agreed to have sex with a sex offender drug addict.

My problem here is this type of behavior doesn't usually just appear all of a sudden. I suspect that he pulled the wool over your eyes or you just didn't give enough time to really know him before you engaged in sex.

"Termination of Parental Rights" is more extreme than limiting or eliminationg his visitation entirely. It is seldom ordered except as a part of an adoption of the child. And without such an adoption, he would still be obligated to pay child support, should you ask for it.

If the father has told you he won't be asking to see your daughter, I assume you are not believing him?
