Search of vehicle for following to close
My son was pulled over for following traffic too closely. The officer asked what drugs he had in the veh and my son said he didn't do drugs. They asked to search the car my son said no. They brought a drug dogs and let it search inside of his car. The came up with a bag from buttons on new clothing and something they said was a sniffing device under his seat. He was charged with poss of paraphernalia even though there were no drugs. He was cuffed while they searched and treated with disrespect after he excised his rights. There were no drugs. How can they do this?

They may search the car in any open areas that they can see. They can not allow the dog in the car without a warrant if he says NO. Thus it was a illegal search in my opinion, but his attorney will have to bring this up in court to have any evidence thrown out.
