My father was admitted hospital yesterday due to bone break. The cause is by a banana skin on the floor inside a shopping mall. May I know is any Malaysian law that can help me talk to the person in charge of the shopping mall, in order to held the shopping mall responsible for the medical fees? My father was send to the hospital by the shopping mall by ambulance. Thanks.

You may have to just hire a lawyer, who can find out the owner easily. You can try asking a security guard who they work for, but it might be a company contracted by the owner, and you can try asking some small shop owners in the mall who they pay rent to. Malls are usually owned by big corporations who aren't anywhere around the actual mall itself. A lawyer for this sort of lawsuit will work on contingency, meaning they don't get paid until you get paid. Lawsuits can drag on for years.

Does your father have medical insurance? If so, when he files a claim, he will indicate that the injury was a result of an accident. His insurance will then contact the mall insurer. At least that's the way it would work in the US. Not sure about Malaysia.

Thank you very much for your reply. My father only have life insurance... Anyway, the shopping mall complex manager said ask us to pay the medical fees first, then claim it back from them. It is around RM9000. Once again, I appreciated much for you're the two opinion posted to me.

That is not unusual. But I would get it in writing that they acknowledge the claim and that you are to submit bills to them for reimbursement.
