Is it considered fraud to collect on a child that is disabled and not in your custody? My son is disabled and has not lived with his father since February 2010. My son has recently been diagnosed with Cancer so I'm not working right now. I went and applied for SSDI and they said that his father has been collecting since 2008 up into this month. Will he go to jail? He has not sent his son a dime of the money that he has collected in his name that was supposed to be for my son. His father is not disabled.

Another thing his father is currently on probation for domestic violence.

What did you tell Social Security when you called or spoke to them ?

They asked me how long my son has lived with me so I told them. And they said he is still receiving SSDI in California. It was also news to me that my son had Government medicaid insurance as well.
