Writ of execution-- Bank accounts frozen!
I was served that an old debt was sold to a collection agency and that agency was granted a judgement in the amount of $4000. I made payment arrangements and paid irregular payments totaling $3790. I was preparing to make the final payment and received notice of a writ of execution on my bank account for $4300! Apparently, the collection agency filed the writ for the original amount plus fees instead of the actual balance that was owed at the time the writ was requested. Is that legal?? How or who do I talk to to show all my receipts for all of the payments that were made? Can I appeal this Writ to prove that paid the majority of the balance off? HELP??

Yes, you can file a motion with the court that issued the writ, to have it vacated.

How much was in your account?
