    Criminal law
    Hi

Wanted to know what will be max penalty or is there any relaxation if a person is first time caught for shoplifting with around 150 CAD and is asked to present in court for explanation.

    Thanks

    Hello kad:

It's not as simple as that. Lot's of factors go into sentencing - too many to determine what your sentence will be, or even if you'll be convicted. I don't know what state you live in or even if you're in the US.

Nevertheless, I have found that when facing the criminal justice system, even if it's for a minor crime, it's best to be represented by a good lawyer.

Since they stated money in CAD I will guess Canada.

But penalty is up to the judge in most cases,

Here in Canada (and the USA), when we talk about location we go CITY, PROVINCE, COUNTRY.

Therefore, you stole this $150 in TORONTO, ONTARIO, CANADA.

You will be charged with “theft under $5,000”.

As for your sentence, probation, community service. Very unlikely you will get jail time. Although since you were only here on vacation/temporary stay, a Judge might look differently, who knows.

My advice is to contact a lawyer and discuss this situation with him/her.
