I had dna and legitimized my daughter. We share custody but she won't let me see her. I was told since we were never married she can refuse to share custody. also while I have her she can take her away at any time she wants.

If you have a court ordered custody... she can't impose her own conditions...

Without one either of you could legitimately refuse to give her back...

I recommend getting one... then if she doesn't follow it... the court can find her in contempt.

If you were never married, absent a court order, she can control visitation. Do you have court ordered visitation? If not, why not?
