I have a tenant in Calif that is on a month to month rental contract. I have been paying the water bill & advised I can no longer do that. She claims I have to give her 90 day notice to change agreement. I say 30 days because we are on a month to month agreement. Please advise WHO is right.

Secondly, she indicates it is MY responsibility to go pick up check and not her responsibility to get it to me because nothing in the agreement indicates it is her responsibility. Is it the tenant's responsibility to get monthly rent to landlord? Please advise.

With regard to rent payments, the agreement must state the name, address and phone number of where rent must be paid. Once you provide that information to the tenant it is the tenant's responsibility to see that the rent is paid there, either by mailing or personal delivery.

With regard to rent increases, for a month-to-month tenancy the landlord must give at least 30 days written notice when the increase is 10% or less. If the increase is more than 10% then the landlord must give 60 days written notice.

Can I assume this is your only rental? Being a landlord is a business and before you start a business you should learn the rules.

You might consider joinging a local landlords association for help.

Yes, Lisa is right on this, so it may appear that you need to redo your entire month to month agreement and provide them a copy that will go into effect with proper notice.
