My manager was recently let go from his job, for allegedly grabbing another employee by her waist and then touching her. He didn't do it, and she has no proof that he did, so when he wins in court, will the owner of the business and his employees have to give him his job back? By Tennessee law, they do. What is your oponion.

First of all, there's no guarantee that he will win in court. This is a civil matter, so the result is based on a preponderance of evidence, not on proof. He has to convince a jury that the company was demonstrably wrong to terminate his employment, which means that the burden is on him.

Even if they are required to give him his job back, he doesn't want it. A severance package and a letter of recommendation should be what he looks for. Staying with a company that you've just sued is usually career suicide... it's extremely easy for the company to set you up for failure.

Most likely he will not get his job back and I would not actually hold my breath on him winning in court, it will be his word against hers, that its, and most likely he and the company is both being sued, my bet the insurance company for the company will settle prior to going to court,
Not admitting any fault of course.

The company will hang him out to dry to get off the hook thierself.
