    I need to remove my 18year old son from our house
    My step son is 19 days away from being 18 years old. He is OUT OF CONTROL! Drugs, theft etc.. I am sure he is stealing from me, I have made is abundantly clear that he will be leaving my house on his 18th birthday. However, his dad called me threating me and he said that as long as the kid is in high school I am responsible to house him,feed him, medical etc... The dad knows what the child is like so he does not want to be responsible him either.

    Is that true? Do I have to wait till he is out of high school?

    Depends on what state this is... most places consider him an adult at 18. And at 18 you can have him evicted. Which the legal process you would have to use.

    At that point tell dad if he wants him he can have him.

    Also, I gave him a written 35 day notice to as to why he needed to leave the premises. He actually took a picture of it and put a caption underneath it saying those are "B.S" reasons.

    So, I have proof that he actually received the letter.

    Unfortunately its 11pm where I am right now so I have to log off, someone else might give more specific info at this point.

    If he doesn't go willingly you go to court to have the eviction enforced where the Sherrifs will come out and physically remove him and his property and then you can change the locks.

    But its important to follow the process to the letter.

    If drugs are involved... call the police. Maybe time in jail will take some of the stupid out of him.

    Threats of legal action (bogus), or some other threats (which may be a criminal act on the dad's part)?

    No. You are a step-parent. As such you have no responsibility to support him.

    Does your spouse (his parent) live with you?
