All right I'm 16 and back in about sept of 2010 me and my dad had a verbal agreement that he would buy me a race car but I had to pay him back in his lawn service. Recently I over heated the motor twice in 1 racing night! He refuses to have it fixed or try to at least! I told him I wanted the money back that I put into it! (I stopped paying after he said he won't have the car fixed) I have two people who are willing to sign aptadavids stating I paid for the car. (not all of it) I paid off around $560 out of $1500 like I said I stopped paying I also have a voice recording where he admits that I paid off $560! Will this be enough proof to get my money back in small claims court? We over heated it about end of June maybe.

Why were you overheating the motor? Why not take good care of the car?

You haven't honored your end of the agreement.

So he did buy you the car, right?
You wrecked it and he didn't want to pay to fix it, right?
You stopped paying for it, right?

The very first line of your post says it all. Your dad did what he agreed to do... he bought you the car. Nowhere did you say that he agreed to fix it if you ruined it. He agreed to buy it, you agreed to pay him back. Now you go on to say that since he's not fixing it, you broke your part of the deal.

So this voice recording proves that you started to pay it back but then stopped and broke your end of the deal because you got upset. Even if you had paid it all off, what court would give you money for the car that you ruined?

Why do you figure that suing your father in small claims is a good idea? How do you figure you would possibly win that since he did what he agreed to do and you did not?

And just to add to this... if I was your father and you pulled this game on me, it would be the last thing I ever got for you or did for you. You sound like a spoiled and incredibly ungrateful kid. You should finish paying off the car and then keep working to get it fixed. I think I can see why your dad decided to not put any more money into that car.

Who's this we that wrecked the car? Was your dad driving it when the engine overheated, or were you? It sounds like you did the damage.

Fact is, he doesn't have to buy you a car, which he did. You drove it, so it's your responsibility to keep it in running order. If you're reckless with it and you damage it, then you need to repair the damage. That's not daddy's responsibility.

Personally, I think you're a spoiled brat, and daddy has done too much for you. Daddy should repossess the car, sell it, and you can learn what being responsible is all about by getting a job and buying your own car. Until then, walking to where you want to go will teach you a valuable lesson.

Now about your so called case. Go ahead, go to court. I'd love to be there when the judge laughs at you and your ridiculous law suit. You can't sue someone for something they bought you just because you want them to buy more. Doesn't work that way princess.

I find it very sad that you would sue someone who has provided all that you have needed over the years, and still more to come. Think about that college education that your father will have to fork over. A car at 16? Wow! You are lucky! Not too many 16-year-olds have a car at that age.

Your father kept up his end of the bargin, so keep your up!

You totally misunderstand, you owe him for the car, it is not his fault the motor went out, and not his duty to fix it.

You have to pay him in full for the race car. Then You can save up money to get it fixed.

You need to tell dad you are sorry, he was very good to even buy it, in the first place.

You sound like a ungrateful brat to me, that has no respect for what he was given.

Pay dad the rest of the money and tell him you are sorry.

If you go to court, he countersues and he wins, you do not have any legal case at all.

So from what you say you were 14 when your dad made this agreement, right? You must be 18 in Illinois to enter into a legal contract.

Be prepared to leave Small Claims Court in handcuffs - it's illegal to record a conversation without the consent of all parties SO unless you told your father you were recording him you have committed a felony.

I'd spend less time racing and more time studying - aptadavids?
