I really hope someone can help me I just recently moved back in with my boyfriend who has full custody of our son, My boyfriend just had to go to rehab do to after effects from being in Iraq he is extreamly depressed and needed to get help but before he left he filled out a regular sheet of paper stating that he is giving up his rights to our child and that I now have full custody of him I guess my question is, is this a legal document or not and what do I need to do to make it legal?

No, it is not a legal document and I doubt if you can get it to be legal. No court is going to affirm his giving up his rights.

So what you have to do is go to court and petition for a change in custody.

No, it is not legal and esp due to his mental health status at the time, would get thrown out of most courts in minutes.

1. one can not just give up custody of a child. And esp give up rights to a child
2. courts will almost never allow rights to be given up
3. unless it was done in motion form, with the court, it has no legal effect or binding.
