    Parental Rights and Child Support
My daughters father had his parental rights terminated for child abandonment. Is he still liable for back child support?

ANY question on law needs to include your general locale as laws vary by area.

Are you sure his rights were terminated? A court rarely issues a TPR and even more rare if doing so will let the parent off the hook for support.

The court may have denied him visitation and legal custody, but that's not the same as terminating parental rights.

Yes, are you sure, that the custody parent did not just get 100 persent or full custody, it is not the same. So they took all of his court ordered child visit away and issued a order he has no rights.

This almost never ever happens and I have never seen it happen for merely not contacting the child.

I apologize I reread the papers. It was child abandonment. He has had no contact with his daughter since she was born and does not respond to child support papers mailed to him. I live in Utah and he is in Texas. I have had sole custody since birth.

This is still unclear. At some point (when?) you took him to court for something. What was that something? Was it full custody? Or what? The court then awarded you something, again what was that something?

Which state was the court in Ut or Tx? What does the court papers say about support?

There was a DCFS case open and he has failed to respond to court summons so they filed for child abandonment in 2011

Ok, so DCFS opened a case and went to court, again for what? He didn't answer the summons, the court ruled exactly what?

Please read the court papers carefully and tell us what they say, not what you think they say, because you are clearly confused about what happened.

Thank you for your time, my attorney answered my question for me and no I am not confused, just read something wrong.

I'm sorry, but you did not appear to understand exactly what happened because you didn't seem able to answer my questions.

I'm glad you got the answer. I apologize if you felt I was insulting you. But you asked a question and for us to answer that question we needed to understand exactly what happened in court.

Yes I have the documentation from court and I was there in court when they were terminated.

This thread is a year and half old. I thought you got an answer to your question from your attorney. Do you still need more help? If so, you still need to answer the questions we asked if you want our help.

I still don't believe his rights were terminated, especially not just for child abandonment and especially if he owed child support.
