I'm a full time student living with an older man (in Las Vegas, NV) who has provided all of my support for nearly year. I recently found out he had a spy camera above my bed, so of course I have to move. Because I found the spy camera he is trying to force me to move. Without a real notice. He had his daughter threaten me with some fake 3 day notice
Papers she got printed off the internet. I told her to go to the court and bring me back real documents. I have no money, no place to go. I made agrangements to move in about 2-3 weeks when I get a benefit check. He told me several times I can stay as long as I needed, that I don't cost him anything as he hasn't paid his mortgage in over 2 years.

I'm a depentdant and haven't paid any bills. What are my rights?

You have no rights other than the right not to be evicted unless it's by law.

What did the Police say about the spy camera?

Why is an older man, unrelated to you, paying all of your bills? You're a dependent - whose dependent?

I don't know what you mean by a "fake" three day notice. The landlord must give you a three-day notice (which is NOT issued by the Court) before beginning the eviction proceeding. If you don't have a lease my guess is that the landlord is going to use the "nuisance" reason to evict you.

"3 DAY NUISANCE NOTICE - Can be used for what you consider a nuisance. It requires a written reason and has absolutely nothing to do with rent money. You do not count the day of service. The defendant has 3 working days to fix the problem. You need to return to Constable's office after the 3 rdday (return must be a business day). Need to follow-up with the 5 DAY UNLAWFUL DETAINER. "

You can't have it both ways now. You threaten him with criminal charges or face eviction. Or work out a temporary stand off whereby he gives you X amount of time and you don't go to the police. (The longer you wait, the weaker the case.)

You can't be his dependent yet since you didn't live there a full year. There are other criteria too: your parents can't be claiming you (as a student), you have to make under a certain amount (under about 4K), among them. But none of that is relevant to an eviction since you are an adult.

I've had some time to think about this and, of course, OP signed off before I got back BUT now that ONE camera has been found and nothing has been done I think whatever turns the landlord on is being exchanged for room and board, sex (of some sort) for money.

I'd live in a shelter before I'd stay in the house with a man I knew had ONE camera trained on me, afraid to call the Police for fear I'd be evicted. Goodness knows where the rest of the cameras are.

Sexual assult. He had the camera above my bed where I slept naked and did other VERY private stuff. He did not have my permission and I did not know he was doing this. He was pretending to be my friend the whole time. Taking avantage of ME.

I kept his house spot clean, cooked every all his meals, served him like I was a waitress, did his laundry, I got up in the morning to make his coffee, took care of his yard, his dogs, so I was exchanging services for rent. BUT NOT MY BODY! He had no right.

Thanks for your response. You're right, its one way or the other. I was concerned about getting a detective pior because I was worried for my safetly. I wanted to wait until I was able to move, but I guess I shouldn't have waited.

First, you seem to be somewhat naïve. You clearly haven't very much of a clue about the real world.

You are a resident in this home. As such you have the same rights as a rental tenant, no more, no less. You can't be thrown out, but you can be evicted. The first step in that process is a vacate notice. That was, the three day notice. The only thing unclear is what grounds were used for the notice. If the wrong grounds were used, that could make it invalid. So I doubt if it was "fake". If you don't vacate before the 3 days are up, then they can go to court for an eviction order. This will then involve a hearing where you can show cause why you shouldn't be evicted. Maybe you can move before the hearing making the matter moot.

You don't indicate whethere you are male or female though your name indicates female. So what it sounds like is this man recognized your naïveté and offered you a room so he can satisfy his voyeurism (your gender doesn't really matter for that).

Now since you found him out, he wants to get rid of you, but may be afraid that you will get him in trouble for illegal surveillance and being a peeping tom.

Where you got the idea that you were a dependent I don't know. You may have been dependent on his largesse, but he cannot claim you on his tax return. And how do you know he hasn't paid on the mortgage? If you are relying on what he told you, I wouldn't. It could be the house is paid off, but if he is two years behind in his mortgage, then it probably would have been foreclosed by now.

Bottom line here you can no longer live there. You might tough it out until you can find a new place (In which case I would dress in the dark). They want you out and you have no right to stay any longer than it takes to get an eviction order. Even if you threaten to expose him as a voyeur, you will still have to get out. If you try such a threat, they could prosecute you for blackmail. If you don't just threaten and go to the police, you will still have to get out.

True. He broke the law with his illegal surveillance. So, as I said, do you want to prosecute him for it? Do you have proof he did it other than the camera? That's why you were advised to hire a detective so you can prove he took pics.

But the bottom line is what I stated above. Basically you were a live in maid exchanging room and board (I'm assuming you ate his food) maid services. So other than the voyeurism, neither of you took advantage of the other.

NRS 200.604 Capturing image of private area of another person; distributing, disclosing, displaying, transmitting or publishing image of private area of another person; penalties; exceptions; confidentiality of image.

Wow - I never said he did. You know there was ONE camera. You have no idea if there are others. You didn't call a Detective. As I said, you could find photos of yourself "doing things" posted on the Internet. Please quote where I said he had a right to your body - I would like to see it.

I sincerely apologize for jumping to conclusion, what I read was:

I may took this out of context, thinking you were implying that I was paying rent by allowing myself to get spied on. Thus using my body to pay rent. I didn't think before I replied I just acted. My apologies.

I don't want to stay, but I also don't want to move into another bad situation. I was waiting on a payment that would enable me to get my own apartment, which I'd be able to move into in 2 weeks. I wanted to avoid imposing on someone else and perhaps getting myself into a worse situation. That's why I was trying to find out my rights it this sort of predicament.

I found out about spy camera by using his computer. I had to watch a video for school on real-time, that's when the surveillance video of my room came up. There was only one steaming video. I then went to my room, put my hand in the air vent. I felt cardboard with holes in it. I then checked all the other air vents, no cardboard. So, I concluded there was only one camera.

I checked the bathroom, didn't find one. Just the one above my bed.

Did you photograph the camera in place? Make a copy of the video?
These would be helpful if you want to prosecute him.

I honestly just want you to be safe - look at the situation and decide what is best for you.

Just make sure you are safe - in all aspects of your life. Problems with these videos could surface at any time, destroying your life.

How old is his daughter? Does she know about the camera? Why is she being so helpful getting the 3 day notice off the net? It's even creepier if she is defending him, criminal if she knew all along - and if this has been done to other women living there.

(PS: re IRS and dependents, a non-relative can be considered a 'qualifying relative.' The main criteria are living there full year, > 50% supported, and income limit, probably around 4K for 2012.)
