I got married in India on Feb 2012 and moved to Florida on same month in H4 visa. Things did not work out between us, as he was a gay. Suffered for 2 months and planned to return home (India) end of April. Now(Sep) in California for education in F1 visa. Please help. How and when can I apply for divorce.

He wants me to come back and promises to change, but I have no interest to go back. Please help ASAP.

You file for divorce in your State of residency once you have met the residency requirements.

You would need to speak with an Attorney.

Is he going to claim your marriage was fraudulent and attempt to get you deported on the grounds of the fraudulent original (H4) visa?
