Does anyone know how the process works if the couple was married in the US but the wife left with the 3 month old son back to home country outside the US and never came back.

If he's in the USA.. he files in the USA (and it follows USA rules then)... doesn't matter where the marriage took place... its where the person filing is a resident of at the time of filing.

He files in state court in the U.S. state where he resides.
