I have never seen my son or even knew I had one until 2yrs ago. She had him taken away for over a year and just got him back. Now there is another CPS case against her. I have never been able to see my son or have anything to do with him. I want to relinquish all parental rights. Can I do this?

Has paternity been established through a DNA test? Do you pay child support?

Yes to both questions

It's unlikely you will be able to relinquish parental rights unless her husband is willing to adopt.

Even if a judge DOES allow you to relinquish, you're still going to have to pay child support. Rights (the ability to decide things on behalf of your child--like schooling, religion, etc) and obligations (the need to make sure your child is fed, clothed, and has a decent roof over his head) are NOT the same thing. And frankly, the taxpayers don't want to pay for YOUR child (through welfare programs).

He already has the husbands last name

If you are paying child support, you are the legal father.

It doesn't matter WHOSE last name he has, the legal parent has to change in order for you to get out of parenting or paying for this child.
