    Car accident in Texas
    I was rear ended,I have insurance and other driver had no license and was not on the insurance policy.my insurance said I had to file a claim under my policy,but deductible is high.Do I file civil suit against driver or owner of vehicle?

    Both for negligence - the owner for allowing an unlicensed driver to operate the vehicle and the driver for unlicensed driving.

    A person does not have to be named on your policy in order to be covered.

    You need to file a claim with the other cars insurance, This is who should be payig this, unless they were specificly excluded, they should be covered even if not listed. Anyone who drives my car is covered, and they don't have to be listed.

    Next if do you not have non insured or under insured coverage on your policy?

    But you can and should sue both
