    No DNA is required if the parents SIGN OVER guardianship. What is the situation?

    Normally not, you have birth certificates to prove you are the parent of the child's parent.

    My grandchild has a case in ky but now that mom live in Ohio now the case has to go to children

    The case was in ky and now that her mother live in Cincinnati it has to go to children service over here and she would like to sign her rights over to me . The courts gave her aunt temporary custody to her but my grandchild does not wish to stay there with her so we are trying to get her with me .please help me.

    So you are trying to get custody of your son's child? Are both your son and the mother agreeable?

    Yes the mother is and son do not wish to take a DNA test if I get her he would like to have her when we move

    The mother is... WHAT? Why do you think A DNA test might be needed? How do you expect us to help you when you don't explain the situation?

    the mother is willing to sign over her right to me .the aunt that is is staying with told me I would need a DNA test, but I know I do not need a DNA test, my son will not take a DNA cause of child support that he think he will have to pay , but there is another man name on the birth c who is not the father my son would like me to give him custody after I move to Whitehall,Ohio .I do not went child support from him or her do I have to get it?

    Okay, so the mother of the child has lost custody of the child to her aunt. Correct?

    Your son is the "presumed" father, but he is not on the birth certificate. Correct?

    If he is not on the birth certificate then yes, he will have to have a DNA test done prior to you getting any form of visitation and/or custody.

    Currently your son has no legal standing. Therefore neither do you. For you to get custody, the father listed on the birth certificate will have to either agree or be replaced as the legal father.
