    Reporting embezzlement of minors settlement
    My nephew was in a car accident and was awarded a large settlement along with his mother. Since she has blown her money, and is now writing checks and saying they are for my nephew, when in fact they are for her. I'm afraid she is going to end up leaving him broke and he has future medical concerns that will need addressing in the future. Is it legal for her to spend his money? I know some of what she is spending is for backrent, and then others is for decorating her house. What do I do?

    If he's a minor she has to report how she spends his money to a Court. Was a trust set up? How is the money handled? Lump sum? Something else.

    In my State - NY - the money can be used to make the residence safe and comfortable.

    You can always contact an Attorney, start a Court proceeding and ask for an accounting. On the other hand, an accounting might be filed routinely.

    Do you have info on how the money was turned over to him/her?

    You need to report this to the court where it is being handled.

    No she should not have access to his money or if she does, have to report the use.
