    Opt out clause
    I will be signing a 5 year commercial lease with purchase option after the 5th year. I want to include a 3 year opt out clause in the event the business doesn't bring in the projected income. How should this clause be stated in the lease ?

    What exactly do you mean by "3 year opt out clause"? You want the right to terminate the lease after 3 years? If so then you can add something simple like "At any time following the third anniversary of this lease Tenant shall have the right to terminate the lease upon ____ days written notice to Landlord."

    The owner of the property is generally the one to write the lease... not the tenant.

    Unless of course you are trying to negotiate this with the owner..
