Can a woman put a mans name on a the birth certificate if he is not present at time of birth
Yes, simply being present at the birth does NOT make someone the father.
Many men do not attend their child's birth for whatever reason.
Should a man respond to a uniform parentage petition if baby is not born yet. What rights do a man have regarding unborn children
Respond the summons... insist a DNA test be done before admitting to anything.
There have been lots of guys that have been inproperly blamed on being the father, that after many years were discovered were NOT the father, many thimes because they made more money.
If DNA test show its yours, then man up and be a good father... even though they can and will make you pay support even if you don't. The kid is better off with both parents in their life, if they set a good example.
Heck even if you marry her... get the test done.
Until the baby is born you have no rights and she is in total control. She can't file for anything until the child is born. Or if she does file just to get it on record, nothing will be done until after the child is born.
It's says or the boxes are checked as if she's interested and a partenal plan lik child support visitation. There's no date for me to paper. Jus saying I hv 30 days to respond. But under baby's name it says unborn. So I guess I'm posed to respond checking the box that says I don't believe I'm the father. But ma question is how can a man be protected from a woman that walks into a court and file because she knws ma name and mine you the baby is not born. How can she legally file if proper parent knowledge has not even been established
She filed - she isn't going to get anything until DNA testing proves you are or are not the father.
She's getting the paperwork started - and possibly the State is paying her benefits and they required her to file.
So you are saying there is no possibility you are the father - all that she knows is your name? Why is she "picking" on you?
What matters most is what the DNA test shows.
Because it's the best defence a man has againt child support payments he might otherwise be wrongly stuck with.
And before DNA testing untold numbers of men have been saddled with payments for kids that might not have been theirs.. just because they had the right blood type it was possible they (allong with thousands or millions of others) could have possibly been the father.
After DNA testing, unless you have an identical evil twin brother... if it says its yours, its yours. Might , may and possibly get removed from the answer.
Your protection is that a court of law has to make a judgment based on facts before your rights are infringed on. She can file, but, as I said, no hearing is going to happen until after she gives birth. So once she does, you counter file for a paternity test before anything further happens.
P.S. We do not use text abbreviations here. Please type in full words and sentences, and check spelling, I think you meant monogamous (having only one partner).
