I have a 10 month old child. The mother and I have been split up for around 7 months now. She's dating a convicted felon and is currently living with him. I have my son 6 nights a week, plus my two off days. Can I have restrictions placed on who he can be around while in her care? Such as not having him around convicted felons? I am concerned about the safety of my child, not someone trying to play daddy. His criminal record consists of theft, vandalism, and selling drugs.

The only people that can put restrictions or conditions on either parent... is family court.

If you have a concern... that would be the venue you want... and what they decide will have the force of law behind it.

We are currently in family court, is that something I can ask for? Or will that be something the judge has to just decide on. My lawyer isn't being very talkative when it comes to it, I think I may have chose the wrong one. The first appearance resulted in just a reschedule for her time to hire counsel.

You may ask for it, but normally unless you can prove the other person is a danger, most likely not.

So basically as long as I can't prove a danger to my sons safety there's nothing I can? What about overnight stays of the opposite sex?

You can ask, it will be up to the court to determine whether there is a real danger. At 10 months, your child won't understand overnight stays of the opposite sex.
