Children's Father $15,985 Behind In Child Support, Can I Collect If He Is On SSI
Background, I had 3 children with a man, he runs off on us when I am 5 months pregnant with our 3rd child. He was absent when I had the child. He has never met the 3rd child. The courts established paternity. Well, the "defaulted" him the father. They arranged for a paternity test, me and our son showed up, he didn't and by default the courts put his name on the birth certificate. A year later in March of 2009 he was ordered by the courts to pay $111 a week. This was established with the help of DHHS. 3 years go by, my kids have yet to receive a dime from him. I call DHHS today and speak to my child support worker and she tells me that in 2011 they got a letter saying that he was on SSI, which makes him exempt from ever having to pay child support to his children. He was on SSI when we were together, so I knew that he was already. We have an existing child support order. I can not collect from SSI for my children because he is on SSI not SSDI. I don't know what to do now. My kids deserve the support payments. I live in NH.
