    Hi,

    My question is I live in New York and was served with court papers regarding a CC debt that I have no idea what it is I have never had a credit card with the bank that they are stating on the court papers... I know I must present myself or at least my answer but I have no idea what this is for... Please advice

    Possible identity theft, I would contact them before going to court and let them know you never had a credit card from them and say the same thing in court. It might take a while to straighten out but they should be able to see that none of the statements were going to your home, they had to have been mailed somewhere... how did they find you if you never had the card or received the statements?

    When I called the Debt collectors they said that it could be an old CC debt of mine that they buy and that they could not provide me with original CC information... I am very confused and I do not want a judgement against me but I am not going to pay something back that I have no idea where it is coming from...

    There are a lot of threads in this forum that deal with this situation. Please review them.

    It could be a mistaken identity case. So you need to inform the court of your intent to defend against the suit. You then need to inform the creditor that they need to provide you with proof of this debt and that all future correspondence be by mail.

    Most likely, since they know they can't prove it, they will not show up in court and the suit will be dismissed.
