    My mother died inJune and my stepdad shortly after, leaving no will, do I have any cl
    My mother died in June 2 years ago and a month later my stepad died. His daughter has claimed alll of their estate and says that I am entitled to nothing, is this true as my mother put as much money(if not more) in to the marriage than my stepdad. His real daughter only came to see him twice a year whereas I saw them both 2-3 times a week.

    Without a will this WILL have to go through Probate Court... and they will determine who gets what.

    Laws vary... what state and country did they reside upon their death?

    Agree you need to probate your mothers estate, you may or may not have a claim to part of what she owned at her death.

    You would have no claim to the step dads estate.

    If mom and step dad owned everything in common, bank accounts homes and the such, most likely it passed all to him. In which case you have no claim,
    But you can challenge your moms estate, not your step dad

    Assuming it wasn't all owned jointly, with right of survivorship, the answer would depend on the intestacy statute for your state. For all I know, your step-father inherited everything from your mother. Which state did they reside in?

    It has absolutely nothing to do with who inherits from your mother.
