I came to us last year 2011 and returned back in Sep 2011, I came back to USA in January 2012 first week. My wife and daughter recently joined me in May 2012. I am currently on H1 and dependents are on H4. I have already filled 2011 tax returns. Can you please clarify if I can apply itin for both now?

Thanks for quick response,
I entered united states in 17 Apr 2011 and left on 30 Sep 2011. I came back on 5th Jan 2012.

I presume you filed as a non-resident alien (filing Form 1040NR) for 2011.

You can file Form 1040 JOINTLY with your wife and submit Forms W-7 to get ITINs for your wife and child when you file the 2012 tax return.

You CANNOT submit the Forms W-7 by themselves without the tax return; if you do, they will be rejected.
