Hi, I'm on L1 visa from Jan 2009. I recently got married and my wife accompanied me on L2 visa and she's not working (yet to apply SSN for her). She was here on tourist visa (B2 visa) earlier and stayed here for around 7 months last year.
My questions are,
1. Is my wife non-resident alien or resident alien?
2. What will be the filing status on the W4 form?
3.Can I file W4 as married filing jointly since I'm resident alien?

1) If she files jointly with you, she CHOOSES to be treated as a resident alien.

2 & 3) If you intend to file jointly henceforth (you can EVEN IF she is not in country), claim MARRIED with TWO allowances.
