My son is almost two and from the time I became pregnant to now his father has had nothing to do with him,his name is not even on any of our sons papers but yet now he pops up and says he's going to get custody of our son can he do that?

He can try. Its unlikely he will get primary custody, but it is likely he will get visitation.
